Conference: Law & Governance Taking a Technocratic Turn?

Globalisation, privatisation and technological advancement have given rise to a regulatory approach featuring technocratic regulation.  Standardisation, Certification, Accreditation & Normalisation (‘SCAN’) signify this trend, originating particularly in the functional areas of law, such as product-safety, food, energy, construction, air traffic, health and ICT. Meanwhile, codifications and general principles of private and public law are increasingly being eclipsed or even ‘hollowed-out’ by a fragmented landscape of technocratic-functional regulation. While the appeal of technocratic regulation lies mainly in effectiveness & efficiency, its universalist, post-political character has given rise to concerns about legitimacy, particularly on procedural and substantive justice.

How does the ‘technocratic turn’ in regulation, particularly through SCAN-instruments, play out in governance; do we have proper evidence of this technocratic turn? What role does law currently play and should law play in future to balance SCAN’s benefits & opportunities with its burdens & threats? And what does the ‘technocratic turn’ mean for the related law and governance scholarship?

Symposium: Constitutional Preambles

There is a global trend towards including a preamble in new constitutions. The main purpose of this symposium is to reflect on the functions of constitutional preambles. In the first panel, Wim Voermans, Maarten Stremler and Paul Cliteur will present their book Constitutional Preambles: A Comparative Analysis (Edward Elgar 2017). In the second panel, three international experts will discuss the process of drafting a preamble as well as its role in law and politics. The third panel deals with the recent proposal to add a quasi-preamble (a general provision) to the Dutch Constitution, focussing on its potential added value.

In het zomernummer van het Tijdschrift voor Constitutioneel Recht onder meer aandacht voor de praktijk van het gemeentelijke referendum en voor de ontwikkelingen in de Koninkrijksverhoudingen onder Rutte II. We invite younger scholars to participate in the first-ever Younger Scholars Forum in Comparative Law, to be held in Fukuoka, Japan on Wednesday, July 25, 2018, from 9:00am to 12:00pm as part of the larger quadrennial Congress of Comparative Law organized by the International Academy of Comparative Law.

Abstracts are invited for eight (8) Workshops and one (1) TED-style Speakers’ Corner. All nine sessions will be held concurrently from 9:00am to 12:00pm on the day of the Forum. More details follow below on the subject-matter of each Workshop and on the format of the Speakers’ Corner. Lees verder

The INFAR Research Excellence Initiative at Erasmus School of Law invites you to a seminar on:

“Recent Developments in Militant Democracy”

In this seminar, prof. Roel de Lange and dr. Nick Efthymiou will give a presentation of a new report they wrote, discussing ways constitutional systems – in particular those of Germany, France, Spain, the United Kingdom and the United States of America – defend themselves against the rise of anti-democratic organizations. The report was written on request of the Dutch government. It was submitted to the Dutch Parliament earlier this year.
Prof. Kim Lane Scheppele, professor of sociology and international affairs at Princeton University, will serve as a discussant.
